Pedicash’s Privacy Policy

 

Your data privacy is our responsibility. Pedicash is a mobile application software (“App”) available on the Google Play Store and Apple App Store (“App”) which you have downloaded onto your mobile phone or handheld device (Device). This Privacy Policy summarizes what personal information we may collect, how we use this information, who we share this information with, how long we retain this information, and your privacy and data protection laws. It is Pedicash’s policy to comply with all applicable privacy and data protection laws. This commitment reflects our value in attaining and maintaining the trust of customers, business partners, and others who share their personal information with us. This privacy policy applies to all Internet sites and mobile applications operated by or on behalf of Pedicash, including other global entities related to Pedicash.

 

It also applies to personal information Pedicash may otherwise collect: 

(i) through our products and services; (ii) when you interact with us by means other than the Pedicash Internet Site or App, i.e. in person, by telephone, or via other means of telecommunications; and (iii) from our employees, collectors, third party investigators, and other business partners (collectively “Business Partners”).



Personal Information that Pedicash Gathers

 

(i) Contact information such as your name, company name, job title, address, e-mail address, and phone number; 

 

(ii) Number of contacts in your mobile device that will only be used for credit evaluation purposes only;

 

(iii) Additional information about you to help us get to know you better such as your gender, age, date of birth, nationality, professional associations and registration numbers, information about how you use our products, and demographic information; 

 

(iv) Comments, questions, requests, and orders you may make; 

 

(v) Financial information needed to process loans and payments such as credit card or account information, or other banking information; 

 

(vi) Log-in information, including, social media account information for login purposes, if applicable; 

 

(vii) Information about your preferences such as your preferred methods of communication and product types in which you are interested, if applicable; and

 

(viii) Your preferred phone contacts in your device needed for collection purposes will be requested to be manually selected and marked as your backup and emergency contacts, if in case the information provided in the credit agreement is false, invalid, or otherwise not responsive to our collection attempts.

 

It is understood that when you submit your data to Pedicash, you are expressly agreeing to the collection and processing of such data, regardless of whether the data may be used for any purpose under the agreement. 



Information Automatically Gathered from Your Device

 

Device information

Pedicash may collect technical information about your devices, such as device type, browser type, IP address, operating system, and device identifier. Pedicash will automatically collect this information from your device and web browser through cookies and similar technologies with your consent. 

 

Information about how you interact with us

Pedicash may collect technical data about your use of the Pedicash Application and how you interact with our digital advertising and promotional activities. Pedicash uses cookies and similar technologies to collect this information with your consent.

 

Information from Business Partners and other Third Parties

Pedicash may collect personal information through our Business Partners. This information may include contact information, such as name, company name, job title, address, email address, and phone number for verification and confirmation purposes.

 

Location information

Pedicash may collect location information, including accurate real-time location information from your device and inaccurate location information such as your IP address. Unless you grant permission, the Pedicash App will not access accurate real-time location information from your device. Pedicash’s access to location is for the protection of Pedicash as our services are only rendered for those who are located in the Philippines. Pedicash’s location access is limited to granting loan applications and other related services, if applicable. 

 

Pedicash may also acquire personal information from other third-party sources, including publicly and commercially available sources. We may combine the information we receive from our Business Partners and other third-party sources with information we gather from you or your device, as mentioned above.



Pedicash may use your personal information to: 

Communicate with you

(i) Informing you of Pedicash products, services, and promotional activities that may be of interest to you; 

 

ii) Providing information about relevant Pedicash products, services, and transactions, including, for example, pricing, information about product or service improvements; 

 

(iii) Responding to questions or inquiries that you make, including customer service requests; and

 

(iv) Inviting you to participate in, or informing you of the results of, customer satisfaction or market research surveys.

 

Develop and manage our relationships with you and our Business Partners

(i) Delivering services or carrying out transactions that you or our Business Partners have requested; 

 

(ii) Providing information about Pedicash products, services, and transactions, and advertisements, that may be of interest to you; and

 

(iii) Providing you and our Business Partners a more consistent experience in interacting with Pedicash, including by learning more about you and how you use and interact with Pedicash Internet Sites, Apps, products, and services; and 

 

(iv) Planning, managing, and performing under our contractual relationships with our Business Partners.

 

Provide and improve our Internet Sites, Apps, products, and services.: 

i) Customizing them to your preferences or interests, making them more compatible with your technology, or otherwise making them easier to use; 

 

(ii) Maintaining the security of and otherwise protecting them; and

 

(iii) Developing new Pedicash Internet Sites, Apps, products and services.

 

Address legal issues

(i) Complying with our obligations to retain certain business records for minimum retention periods; 

 

(ii) Establishing, exercising, or defending legal claims; 

 

(iii) Complying with laws, regulations, court orders, or other legal processes; 

 

(iv) Detecting, preventing and responding to fraud, intellectual property infringement, violation of our contracts or agreements, violations of law, or other misuses of Pedicash Internet Sites, Apps, products or services; and 

 

(v) Protecting Pedicash’s rights or property, or yours or others’ health, safety, welfare, rights, or property.

 

Pedicash may also use your personal information for other purposes consistent with the context in which the information was collected or with your consent. Pedicash may anonymize or aggregate any information we collect and use it for any purpose, including for research and product-development purposes. Such information will not identify you personally.



Pedicash will not disclose your personal information except as described here:

 

Pedicash may share your personal information with third parties hired by us in order to provide us with support services, such as but not limited to collection services, background checks, skip tracking, etc. These third parties need to use the personal information we share to cooperate with them only to provide services on our behalf and to provide services on our behalf and to process your personal information in compliance with all applicable privacy and data protection laws. In some cases, Pedicash may share your personal information with third parties that cooperate with us to provide products and services to our customers. If so, we will require our Business Partners to use this information in a manner that complies with this Policy, any applicable Specific Privacy Statements, and all applicable privacy and data protection laws. 

 

Pedicash may share your personal information with third parties when we have a good faith belief that disclosure is necessary:

 

(i) to comply with a law, regulation, court order, or other legal processes;

(ii) to detect, prevent, and respond to fraud, intellectual property infringement, violation of our contracts or agreements, violation of law, or other misuses of Pedicash Internet Sites, Apps, products or services; 

(iii) to protect Pedicash rights or property or yours or others’ health, safety, welfare, rights, or property; or 

(iv) under similar circumstances. If such an event occurs, we will take appropriate steps to protect your personal information. 

 

Pedicash may share your personal information with third parties related to the sale, purchase, merger, re-organization, liquidation, or dissolution of Pedicash or Pedicash’s business unit, or under similar circumstances. If such incidents occur, we will take appropriate measures to protect your personal information. Pedicash may share your information with your permission or at your request. Pedicash may share anonymous or aggregate information internally and with third parties for any purpose. Such information will not identify you individually.

 

The Applicant agrees that Pedicash, directly or through its Partners, may collect, retrieve, process, use and store his/her personal data such as name, age, photographs, fingerprints, other biometric data (e.g., facial recognition and voice recognition), mobile number/s, mobile phone usage data, employment details, income, financial data, financial profile, credit standing, loan payment history, and other information required in the application form for the purpose of reviewing and processing the Applicant’s loan application. The Applicant consents to the collection of his/her personal data from the Applicant her/himself, or from other personal information controllers such as, but not limited to, telecommunications companies, for credit scoring purposes. The Applicant’s personal data such as mobile number, email address, and address, will be shared to a credit scoring service provider for credit investigation, credit scoring, data analytics, and data profiling, which includes the regular updating of the Applicant’s credit score. The personal data secured may also be used for direct marketing of products and services of Partners

 

Throughout the processing of the Applicant’s personal data, his/her rights under the Data Privacy Act of 2012, such as the (1) right to be informed, (2) right to object, (3) right to access, (4) right to rectification, (5) right to erasure or blocking, and (6) right to damages, shall be upheld. Entities to whom we share your data will also respect the same rights.



Security Safeguards

Your personal information is usually stored in the Pedicash database maintained by our service providers. Many of these databases are stored on servers located in the Philippines. Pedicash adopts appropriate measures through contracts or other means to provide adequate protection for personal information that is disclosed to third parties or transmitted to another country/region, including transmission within Pedicash. Pedicash takes reasonable protective measures to protect the confidentiality, security, and integrity of your personal information. 

Although we use security measures to help protect your personal information from unauthorized disclosure, misuse, or alteration, just like all computer networks connected to the Internet, we cannot guarantee the security of information provided over the Internet and will not be responsible for breaches of security beyond our reasonable control. Pedicash is not responsible or liable for any data leakage, abuse, disclosure or illegal sharing caused by the user’s fault in protecting, and securing his username and password - or some other form of negligence. 



Right as a data subject

You may contact Pedicash’s Data Privacy Officer at dpo@pedicash.ph to exercise your rights as a data subject. The following are your rights:

 

Right to be informed

You should be informed of Pedicash’s process in collecting, usage, sharing and gathering of your information and your rights as a data subject.

 

Right to access

A copy of your personal data may be requested and how your data are being processed unless gathering this information may affect the rights and freedoms of others or applicable law requires that we do not adhere to your request.

 

Right to rectification

A request to correct information which you believe is inaccurate can be done. An update of this request shall be sent to you if proper actions have been executed. Regarding this request, we will require you to submit supporting documents or details to show authenticity of the said changes.

 

Right to erasure or blocking

Personal data can be asked to be erased if you think that this information is no longer of use for our company; if you doubt our processors of your data; if these data of yours are being used unlawfully and/or certain laws require you to do so.

 

Right to data portability

You as a client should have the right to know the movement, copy or transfer of your data with proper security features.

 

Right to damages

As a data subject, if anything has happened to you regarding data privacy you have the right to collect proper compensation regarding the damages that you suffered or if there is any violation of your rights and freedom.

 

Right to file a complaint

If there is any damage or violation of your rights and freedom regarding data privacy, you have the right to file a complaint to the National Privacy Commission.



Information Storage

Information from your device will be stored or retained by Pedicash for as long as the purpose is listed in our Privacy Policy. Following purposes are:

 

(i) If the information is necessary to comply with any legal obligation;

(ii) If authorized by law; and 

(iii) For the company’s legal defences.

 

If information is no longer needed, the collected shall be deleted or anonymized except as necessary to comply with legal obligations.

Revision of Privacy Policy

Changes to this Privacy Policy will be posted on the Pedicash website and app, along with information on any material changes. Pedicash reserves the right to update or modify this Policy and any Specific Privacy Statements at any time and without prior notice. Any modifications will apply only to the personal information we may have collected and those we will collect after the posting.
